Privacy Policy
Ohana Style Realty
1. Introduction
Ohana Style Realty (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, share, retain, and protect information obtained through our website, real estate services, online advertising, and communications. It covers website and IDX forms, home valuation requests, Facebook and Instagram lead forms, appointments, email, telephone, and text communications. This policy is a notice about our practices; accepting it does not by itself authorize marketing messages.
2. Information We Collect
We may collect names, email addresses, telephone numbers, mailing and property addresses, preferred contact methods, preferred neighborhoods and property types, budgets, buying or selling timelines, financing preferences, property inquiries, saved searches, and information voluntarily provided. When you use our website, technical data may include IP address, device and browser information, referral sources, pages viewed, cookies, and advertising interactions. We may retain communications and real estate transaction records.
3. Sources of Information
Information may come directly from you through contact forms, property searches, consultations, Facebook or Instagram lead forms, calls, texts, emails, or real estate transactions. We may also receive information from referrals, service providers, advertising platforms, public property records, IDX services, and transaction participants, as permitted by law.
4. How We Use Information
We use information to respond to inquiries; provide buyer, seller, and real estate services; schedule appointments and showings; deliver requested property listings and market information; manage relationships and transactions; send permitted communications; improve our website and marketing; prevent fraud; secure systems; and meet legal obligations. Where a particular use requires consent, we seek that consent separately.
5. Email Communications
We may email you about inquiries, property information, appointments, or other requested services. Where permitted, we may also send market updates or marketing emails. Commercial marketing messages will include required identification and unsubscribe options. You may unsubscribe using the message link or by contacting us; certain transactional or individually requested communications may continue as permitted by law.
6. Telephone and Text Messaging
We may call or text to respond to your requests and coordinate real estate services. We obtain consent for marketing or automated text messages where required. Providing a phone number, submitting a form, or viewing this policy does not by itself constitute consent to receive automated marketing texts. If you separately opt in, messages may concern property information, appointments, buyer or seller updates, and promotions consistent with your consent. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance; you may also contact us using the details below. Consent to marketing texts is not a condition of purchasing services. We do not sell or share mobile numbers or SMS opt-in consent information with third parties for their own marketing purposes. Service providers may process messaging data solely to support our communications. We maintain opt-out records as appropriate.
7. Facebook, Instagram, and Other Lead Forms
When you submit a lead form through Facebook, Instagram, or another platform, we may receive your name, contact information, real estate preferences, budget, timeline, and financing information. We use these details to respond to your request and provide relevant services. The platform may separately process information under its own privacy policy. A lead form submission alone does not authorize automated marketing texts.
8. Property Search and IDX Tools
Our site may provide property searches, saved listings, listing alerts, and MLS information through third-party IDX technology. These providers may process registration information, search activity, and inquiries to operate the tools. Their services may be subject to separate privacy notices.
9. Cookies, Analytics, and Advertising
Our website may use cookies, pixels, analytics, and advertising tools, including services provided by Google and Meta, to support functionality, understand website usage, and measure campaigns. Some advertising-related disclosures may be considered targeted advertising or a sale under applicable privacy laws, even when money is not exchanged. Where legally required, we provide applicable notices and choices, including recognized universal opt-out mechanisms. You may also manage browser cookie settings. The availability and operation of choices depend on applicable law and the technologies actually used.
10. Sharing of Information
We may disclose information to service providers supporting website hosting, CRM, email and SMS delivery, IDX searches, advertising, analytics, transaction management, and electronic signatures; to appropriate transaction participants and professional advisers; and when legally required or necessary to protect rights and security. Providers working on our behalf are expected to use information for authorized purposes and maintain appropriate safeguards. We do not sell SMS opt-in consent information for third-party marketing.
11. Data Security and Disposal
We use reasonable administrative, technical, and organizational safeguards appropriate to the information we maintain. Access is limited where appropriate, and we seek appropriate safeguards from service providers. We maintain procedures for secure disposal of covered personal identifying information as required by applicable Colorado law. No electronic system can be guaranteed completely secure.
12. Security Incidents
We investigate suspected security incidents and provide notices to affected individuals or authorities when required by law. Colorado law generally requires notice of qualifying breaches without unreasonable delay and within 30 days after determination, subject to statutory conditions and exceptions.
13. Retention and Brokerage Records
We retain information as reasonably needed to provide services, manage relationships, maintain required records, resolve disputes, and meet legal obligations. Colorado Real Estate Commission Rule 6.20 generally requires retention of specified transaction files for four years from consummation or expiration of an unsuccessful listing contract, as applicable. Other records may have different retention periods. When information is no longer needed, we take appropriate steps to delete, anonymize, or securely dispose of it, subject to legal requirements. We may retain limited suppression records to honor opt-outs.
14. Your Choices and Privacy Rights
Depending on applicable law, you may have rights to access, correct, delete, or obtain a copy of certain personal information, and to opt out of certain uses such as targeted advertising or qualifying sales of data. Rights may be subject to verification, legal exceptions, and recordkeeping obligations. Contact us using the details below to make a request. We respond within applicable legal deadlines.
15. Colorado Privacy Act
The Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.) applies to businesses meeting specified thresholds and other statutory conditions. If it applies to our activities, we will provide eligible consumers with the rights, notices, opt-out methods, and appeal processes required by law, including applicable treatment of sensitive data and recognized universal opt-out mechanisms. We do not represent that every right described in the Act applies to every interaction with our brokerage.
16. Other State Privacy Rights
Residents of other states may have additional privacy rights where the applicable law covers our business and processing activities. We will honor rights and provide notices where required. Contact us for assistance with a privacy request.
17. Children’s Privacy
Our real estate services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13 without legally required authorization. Contact us if you believe a child provided information so we can review the matter.
18. Third-Party Links
Our website may link to independent property search services, lenders, and other websites. Their privacy practices are governed by their own policies, and we encourage you to review them.
19. Policy Updates
We may update this Privacy Policy to reflect changes in law, technology, or our practices. Updates will be posted on this page with a revised effective date. We will provide additional notice or obtain consent where legally required.
